To use the Services, including accessing or browsing our online stores, purchasing any of our merchandise, sponsorship packages, or digital content, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

 

SECTION 2 - OUR PRODUCTS AND SERVICES

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.

We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.

SECTION 3 - ORDERS AND SPONSORSHIPS

When you place an order or purchase a sponsorship package, you are making an offer to purchase. Axis Media TV reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Axis Media TV confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Axis Media TV may be unable to accommodate cancellation requests after an order is accepted.

For sponsorship packages, specific deliverables and timelines will be outlined in your order confirmation and any additional agreements. Sponsorship services are subject to our content creation schedule and may require additional time for production and delivery.

In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.

Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export, unless specifically agreed upon in writing for business partnerships.

 

SECTION 4 - PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

Prices posted in our online stores may be different from prices offered through partnerships or direct negotiations. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

For recurring services such as VIP memberships or ongoing sponsorship packages, billing will occur according to the specified billing cycle. You authorize us to charge your designated payment method for all recurring fees.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

SECTION 5 - SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

For digital content and services, delivery will be provided through email, digital download, or account access as specified in your purchase confirmation.

 

SECTION 6 - INTELLECTUAL PROPERTY AND CONTENT

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video content, audio content, athlete interviews, action sports footage, and the design, selection, and arrangement thereof, are owned by Axis Media TV, its affiliates, content creators, or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.

Content Creation and Revenue Sharing: For content creators working with Axis Media TV under our revenue sharing agreements, specific terms regarding content ownership, usage rights, and revenue distribution will be outlined in separate Creator Agreements. This includes our standard 60/40 revenue split model for qualifying content creators.

Axis Media TV's names, logos, product and service names, designs, and slogans including "Where Action Speaks Louder," "Raw. Ranked. Real-Time," and "Built by Athletes, for Athletes" are trademarks of Axis Media TV or its affiliates or licensors. You must not use such trademarks without the prior written permission of Axis Media TV.

 

SECTION 7 - USER-GENERATED CONTENT AND SUBMISSIONS

When you submit content to Axis Media TV, including but not limited to comments, reviews, videos, photos, contest entries, or other materials ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

For content submissions that may be featured in our main content channels or monetized content, additional terms and compensation may apply as outlined in separate agreements.

You represent and warrant that you own or have the necessary rights to all User Content you submit and that such content does not violate the rights of any third party.

 

SECTION 8 - SPONSORSHIP AND PARTNERSHIP TERMS

Sponsorship packages purchased through our Services are subject to the following additional terms:

  • Sponsorship deliverables will be completed within agreed-upon timeframes

  • Content featuring sponsors will maintain Axis Media TV's editorial standards

  • Sponsors will receive the promotional benefits outlined in their specific package

  • Changes to sponsorship requirements must be agreed upon in writing

  • Sponsorship content will be distributed across our specified channels and platforms

VIP membership benefits include access to exclusive content, early product releases, and special pricing on merchandise and services.

 

SECTION 9 - COMMUNITY GUIDELINES

As a member of the Axis Media TV community, you agree to:

  • Respect fellow community members and content creators

  • Provide honest feedback and reviews

  • Not engage in harassment, hate speech, or discriminatory behavior

  • Respect the authentic, unfiltered nature of our content while maintaining basic decency

  • Not spam or engage in commercial solicitation without permission

We reserve the right to moderate, edit, or remove content that violates these guidelines or our community standards.

 

SECTION 10 - THIRD-PARTY LINKS AND AFFILIATE RELATIONSHIPS

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including affiliate links and sponsor content. We may receive compensation for purchases made through affiliate links. We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access.

Our UpPromote affiliate program allows qualified individuals to earn commissions by promoting our products and services. Affiliate terms are governed by separate agreements.

 

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Axis Media TV is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Axis Media TV. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Axis Media TV, including any injury, damage, or loss resulting from purchased products and services.

 

SECTION 12 - PRIVACY POLICY AND DATA COLLECTION

While we strive to provide accurate information about action sports, techniques, equipment, and industry news, you acknowledge that:

  • Action sports involve inherent risks

  • Our content is for informational and entertainment purposes

  • You should always use proper safety equipment and techniques

  • We are not responsible for injuries resulting from attempting activities shown in our content

  • Equipment reviews and recommendations are opinions and not guarantees of performance

 

SECTION 14 - PROHIBITED USES

In addition to standard prohibited uses, you specifically may not:

  • Copy or redistribute our exclusive action sports content

  • Attempt to circumvent our revenue sharing or affiliate systems

  • Use our platform to promote competing action sports media brands without permission

  • Engage in activities that could harm the reputation of featured athletes or sponsors

  • Violate the spirit of authentic, unfiltered action sports culture that defines our brand

 

SECTION 15 - SUBSCRIPTION AND RECURRING SERVICES

For VIP memberships and other subscription services:

  • Billing occurs automatically according to your selected plan

  • You may cancel at any time through your account settings

  • Cancellation takes effect at the end of your current billing period

  • No refunds for partial periods unless required by law

  • Subscription benefits are non-transferable

 

SECTION 16 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL AXIS MEDIA TV, OUR PARTNERS, CONTENT CREATORS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

 

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Axis Media TV, Shopify, and our affiliates, partners, content creators, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of your breach of these Terms of Service, your violation of any law or the rights of a third party, or your access to and use of the Services.

 

SECTION 18 - CHANGES TO TERMS OF SERVICE

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website.
